1. Introduction

The Energy Efficiency and Conservation Act (EECA) 2024 was enacted to regulate the efficient consumption and conservation of energy in Malaysia. The Act aims to improve energy efficiency across various sectors, reduce energy wastage, and support Malaysia’s environmental commitments, including the aspiration to achieve carbon neutrality by 2050.

The Act applies to large energy consumers, specific buildings, and energy-using products. It sets out the roles, responsibilities, and compliance requirements for relevant stakeholders.

2. Functions and Duties of the Commission

The Energy Commission is responsible for overseeing the implementation of the EECA 2024. Its functions include advising the Minister on energy efficiency policies, recommending regulatory measures, promoting private sector investments, setting energy efficiency targets, and enforcing compliance.

The Commission may also conduct studies, audits, research, and publish statistics and information relating to energy efficiency.

3. Duties of Energy Consumers
  • Appointment of a Registered Energy Manager (REM):
    Energy Consumers must appoint a REM to implement and monitor the Energy Management System and ensure compliance.
  • Implementation of an Energy Management System (EnMS):
    Energy Consumers must develop and implement an EnMS within the prescribed period based on Commission guidelines.
  • Submission of Energy Efficiency and Conservation Reports:
    The REM must prepare and submit reports detailing energy consumption, management practices, and improvement measures.
  • Conduct of Energy Audit:
    Energy audits must be conducted by a Registered Energy Auditor (REA) and submitted to the Commission.
4. Duties of the Person in Charge of a Building
  • Application for Energy Intensity Label:
    The person in charge must apply for and display an Energy Intensity Label indicating the building’s energy performance.
  • Compliance with Energy Intensity Performance Standards:
    If a building does not meet the prescribed standards, an energy audit and improvement plan must be prepared.
  • Energy Efficiency Improvement Plan:
    The plan must be submitted for approval and implemented within the specified timeframe.
5. Registration of Energy Managers and Energy Auditors
  • Registration Requirement: Energy Managers and Energy Auditors must be registered with the Commission and hold valid practising certificates.
  • Qualifications: Applicants must fulfil prescribed qualifications and other requirements set by the Commission.
  • Renewal of Registration: Registration must be renewed periodically and may require proof of continuing professional development.
  • Cancellation: Registration may be cancelled for non-compliance, misconduct, or fraudulent activities.
6. Registration of Training Institutions
  • Registration Requirement: Training institutions must be registered and hold valid certificates.
  • Eligibility: Institutions must be legally established under Malaysian law and comply with requirements set by the Commission.
  • Renewal: Renewal must be done within the prescribed period. Late applications may incur additional fees.
  • Cancellation: Registration may be cancelled if provisions of the Act are violated or if fraudulent practices are detected.
